In Scotland, for hundreds of years, juries have chosen between three criminal verdicts: “guilty,” “not guilty,” and “not proven.” The “not proven” verdict’s legal meaning remains mysterious. In this article, I aim to describe and solve the problem. Applying modern ideas about standards of proof to the intellectual history of “not proven” yields eight plausible meanings for the verdict. With the extent of the problem in mind, I offer a solution. In the three-verdict system, jurors should deliver a “guilty” verdict (...) when they believe that the accused has committed the crime and a “not guilty” verdict when they believe that the accused has not committed the crime. The “not proven” verdict is for all other states of mind. Clarifying this question matters for determining whether the verdict’s existence is just. It also offers some evidence for how the criminal standard of proof works in other legal systems. (shrink)

By analyzing a gedanken experiment designed to measure the distance l between two spatially separated points, we find that this distance cannot be measured with uncertainty less than (ll 2 P) 1/3 , considerably larger than the Planck scale lP (or the string scale in string theories), the conventional-wisdom uncertainty in distance measurements. This limitation to space-time measurements is interpreted as resulting from quantum fluctuations of space-time itself. Thus, at very short distance scales, space-time is “foamy.” This intrinsic foaminess of (...) space-time provides another source of noise in the interferometers. The LIGO/VIRGO and LISA generations of gravity-wave interferometers, through future refinements, are expected to reach displacement noise levels low enough to test our proposed degree of foaminess in the structure of space-time. It remains unclear whether such genetic variants are associated with disease aggressiveness. The NCI-SPORE Genetics Working Group retrospectively collected clinicopathologic information and genotype data for 36 SNPs which at the time had been validated to be associated with PC risk from 25,674 cases with PC. Cases were grouped according to race, Gleason score and aggressiveness. Statistical analyses were used to compare the frequency (...) of the SNPs between different disease cohorts. After adjusting for multiple testing, only PC-risk SNP rs2735839 was significantly and inversely associated with aggressive and high-grade disease in European men. Similar associations with aggressive and high-grade disease were documented in African-American subjects. The G allele of rs2735839 was associated with disease aggressiveness even at low PSA levels in both European and African-American men. Our results provide further support that a PC-risk SNP rs2735839 near the KLK3 gene on chromosome 19q13 may be associated with aggressive and high-grade PC. Future prospectively designed, case-case GWAS are needed to identify additional SNPs associated with PC aggressiveness. (shrink)

Etiquette and other merely formal normative standards like legality, honor, and rules of games are taken less seriously than they should be. While these standards are not intrinsically reason-providing in the way morality is often taken to be, they also play an important role in our practical lives: we collectively treat them as important for assessing the behavior of ourselves and others and as licensing particular forms of sanction for violations. This chapter develops a novel account of the normativity of (...) formal standards where the role they play in our practical lives explains a distinctive kind of reason to obey them. We have this kind of reason to be polite because etiquette is important to us. We also have this kind of reason to be moral because morality is important to us. This parallel suggests that the importance we assign to morality is insufficient to justify it being substantive. (shrink)

This series will include monographs and collections of studies devoted to the investigation and exploration of knowledge, information and data-processing systems of all kinds, no matter whether human, (other) animal or machine. Its scope is intended to span the full range of interests from classical problems in the philosophy of mind and phi losophical psychology through issues in cognitive psychology and socio biology (concerning the mental capabilities of other species) to ideas related to artificial intelligence and computer science. While primary (...) emphasis will be placed upon theoretical, conceptual and epistemologi cal aspects of these problems and domains, empirical, experimental and methodological studies will also appear from time to time. Among the most challenging and difficult projects within the scope of artificial intelligence is the development and implementation of com puter programs suitable for processing natural language. Our purpose in compiling the present volume has been to contribute to the foundations of this enterprise by bringing together classic papers devoted to crucial problems involved in understanding natural language, which range from issues of formal syntax and logical form to those of possible-worlds and situation semantics. The book begins with a comprehensive introduc tion composed by Jack Kulas, the senior editor of this work, which pro vides a systematic orientation to this complex field, and ends with a selected bibliography intended to promote further research. ABSTRACT Pediatric psychologists have much to contribute to growing efforts to mitigate the impact of parent mental and behavioral health problems on children’s health and development. However, providing parent-focused psychological services within the pediatric setting brings many new ethical considerations and challenges. Guided by the American Psychological Association’s Ethics Code, this paper presents an ethical case for providing these types of services, followed by a comprehensive analysis of the unique ethical challenges likely to be encountered when doing so. The Identity Theory, therefore, must stand or fall on its reputed conceptual advantages over Dualism. Then the conceptual issues at stake in the mind-brain problem are discussed. The kernel of truth present in the Identity Theory is shown to be obscured by all the talk about reducing sensations to neural processes. An attempt is made to (...) characterize pain adequately as a pattern or complex of bodily processes. This view is then reconciled with the asymmetry in the way one is aware of one's own pains and the way in which others are. This asymmetry constitutes an epistemological dualism which no philosophical theory or scientific experiment could alter. The sense in which experiences are both mental and physical is thus elucidated. A Multi-Aspect Theory of the mind is presented and defended. Five aspects of pain are discussed in some detail: experiential, neural, bodily, behavioral and verbal. Having a mind characteristically involves having all of these features except the bodily (i.e., a physical irregularity). The European Union welfare standardsfor intensively kept pigs have steadilyincreased over the past few years and areproposed to continue in the future. It isimportant that the cost implications of thesechanges in welfare standards are assessed. Theaim of this study was to determine theprofitability of rearing pigs in a range ofhousing systems with different standards forpig welfare. Models were constructed tocalculate the cost of pig rearing (6–95 kg) in afully-slatted system (fulfilling minimum EUspace requirements, Directive 91630/EEC); apartly-slatted system; a high-welfare,straw-based system (...) (complying with the UK-basedRoyal Society for the Prevention of Cruelty toAnimals, Freedom Food standards) and afree-range system. The models were also used toassess the consequences of potential increasesin space allowance, and to estimate the cost ofrearing pigs under organic standards.The cost of rearing pigs ranged from92.0 p/kg carcass weight (cw) and 94.6 p/kgcw forthe partly-slatted and fully-slatted systems,to 98.8 p/kgcw and 99.3 p/kgcw for the FreedomFood and free-range systems respectively. Whenspace allowance was increased by 60% to levelsin a recent proposal to revise pig welfareDirective (91/630/EEC), the rearing costs wereunchanged for the free-range system but rose by4.6 p/kgcw for the fully-slatted system. Rearingcosts under organic standards were 31% higherthan in the free-range system. These resultssuggest that improved pig welfare can beachieved with a modest increase in cost. (shrink)

We question the usefulness of Pylyshyn's dichotomy between cognitively penetrable and cognitively impenetrable mechanisms as the basis for his distinction between cognition and early vision. This dichotomy is comparable to others that have been proposed in psychology prompting disputes that by their very nature could not be resolved. This fate is inevitable for Pylyshyn's thesis because of its reliance on internal representations and their interpretation. What is more fruitful in relation to this issue is not a difficult dichotomy, but a (...) different look at perception such as proposed by Gibson (1979). (shrink)

This is probably the most important book on perception since R. J. Hirst's The Problems of Perception. Ben-Ze'ev presents a highly original, very detailed, comprehensive, and plausible theory of perception, cognition, and other mental phenomena At last we have a viable alternative to the troubled dualistic, representational, "veil of perceptions" theories initiated in the seventeenth century and to the equally troubled materialistic, reductionist theories of the Churchlands et al. Ben-Ze'ev has made a brilliant synthesis of some of the most fruitful (...) ideas of Aristotle, Kant, and others, and he shows that many recent findings in psychological experiments confirm, or are more compatible with, his theory than the alternatives. He defines perception as an "intentional state of direct awareness of the environment." Ben-Ze'ev makes a very convincing case for his nonreductionist, holistic, intuitively plausible, and empirically-grounded theory. The world that physics is gradually disclosing to us is not the "perceptual environment" because it belongs to a different level of description. This parallels his explanation of the relationship between neural states and mental states, which is not that of cause and effect. Rather, they are stratified and belong to different vocabularies and different categories. Ben-Ze'ev has a version of the dual-aspect or multi-aspect theory of mind and body which strikes me as the only remotely plausible approach. The physical world may not be the world we know and love but the world of sights and sounds is real in its own way. Each sort of perceiver has its own kind of access to genuine, emergent properties of the world. (shrink)
